What are the consequences of Non- Compliance
Anyone who is registered or licenced with the FSSAI must adhere to the laws and regulations of the FSS Act. A food safety officer examines the facilities of the food business owner and utilises a checklist to evaluate compliance with applicable rules. Based on the level of compliance, the food safety officer issues a grade:
Compliance (C)
Non-compliance (NC)
Partial compliance (PC)
Not applicable/Not observed (NA)
Under Section 32 of the FSS Act, 2006, the food safety officer may issue an improvement notice if appropriate. After giving the licensee an opportunity to show reason, the officer may suspend or revoke the license if the business operator fails to comply with the improvement notice. Any food business owner who has been affected by an improvement notice has the right to file a complaint with the state's food safety commissioner. The judgement can be challenged in the Food Safety Appellate Tribunal/High Court.
